RESPONSIBILITIES OF MERCHANTS AND LOGISTICS SERVICE PROVIDER

1. Obligations of the Carrier

  • Ensure transportation: Ensure the complete and safe transportation of goods to the designated location within the agreed timeframe.

  • Deliver goods: Deliver the goods to the authorized recipient.

  • Transportation costs: Bear the costs related to the transportation of goods, unless otherwise agreed.

  • Insurance: Purchase civil liability insurance as required by law.

  • Compensation for damages: Compensate the shipper for damages if the carrier loses or damages the goods, unless otherwise agreed or specified by law.

2. Rights of the Carrier

  • Verify goods: Check the authenticity of the goods, the bill of lading, or equivalent shipping documents.

  • Refuse transportation: Refuse to transport goods that do not match the type specified in the contract.

  • Request payment: Demand the shipper to pay the full transportation fee on time.

  • Refuse to transport prohibited goods: Refuse to transport prohibited items or goods that are dangerous or toxic.

3. Obligations of the Shipper

  • Pay transportation fees: Pay the full transportation fee to the carrier according to the agreed timeline and method.

  • Provide necessary information: Provide necessary information related to the transported goods to ensure their safety.

  • Supervise goods: Supervise the goods during transportation, if agreed. If the goods are lost or damaged while under the shipper's supervision, no compensation will be provided.

4. Rights of the Shipper

  • Request timely delivery: Request the carrier to transport the goods to the correct location and time as agreed.

  • Receive goods: Personally or designate a third party to receive the transported goods.

5. Compensation for Damages

  • Carrier’s responsibility: The carrier must compensate the shipper for damages if the goods are lost or damaged.

  • Shipper’s responsibility: The shipper must compensate the carrier and third parties for damages caused by dangerous or toxic goods that are not adequately packaged or secured during transportation.

  • Force majeure: In cases of force majeure leading to the loss, damage, or destruction of the transported goods, the carrier shall not be liable for compensation, unless otherwise agreed or specified by law.
