5. Responsibilities of traders and logistics service providers for the provision of goods documents in the process of delivery and receipt
Obligations of the carrier:
– Ensure adequate and safe transportation of assets to the designated location, on time.
– Assign the property to the person who has the right to receive it.
– Bear expenses related to the transportation of assets, unless otherwise agreed.
– Buy civil liability insurance in accordance with the law.
– Compensation for damage to the carrier in case the carrier loses or damages property, unless otherwise agreed upon or otherwise provided for by law.
- Provide full documentation of goods when delivering goods to customers. These documents include invoices, delivery notes, delivery records, and other relevant documents as prescribed.
Rights of the carrier
– Check the authenticity of the property, of the bill of lading or other equivalent transport document.
– Refusing to transport assets that are not in accordance with the type of assets agreed upon in the contract.
– Request the transport hirer to fully pay the freight on time.
– Refusing to transport assets banned from trading, assets of dangerous or toxic nature
Obligations of the transport hirer
– Fully pay the freight to the carrier within the agreed time limit and method.
– Provide necessary information related to the transported assets to ensure the safety of the transported assets.
– Take care of the property on the way of transportation, if there is an agreement. In case the transport hirer takes care of the property but the property is lost or damaged, it shall not be compensated.
Rights of the charterer
– Request the carrier to transport the property to the right place and time as agreed.
– Directly or appoint a third person to receive back the chartered property.
Liability for compensation for damage
– The carrier must compensate the carrier for damage if the property is lost or damaged.
– In case there are no measures to pack and ensure safety during transportation
The transport hirer must compensate the carrier and the third party for damage caused by the transported property of a dangerous or hazardous nature.
– In case of force majeure resulting in the loss, damage or destruction of transported property during transportation.
The carrier is not responsible for compensation for damage, unless otherwise agreed upon or otherwise provided for by law.
